Guide for obtaining a Dealers License in Georgia

1. ATTEND A GA PRE LICENSE CLASS
While you have already completed this requirement, don’t forget to Retain the Education Certificate, Post it on the Wall at your dealership, and include a copy of the certificate with the Dealer Application- (must be within 12 months or the attendance date or you will need to retake the class)

2. FORM A GA CORPORATION
(if applicable to your business structure) - While you can apply as an individual, most people prefer to register their dealership as a corporation.

3. OBTAIN A FEDERAL TAX NUMBER FOR YOUR BUSINESS (AKA EIN)
Federal Tax ID Number -Obtain an EIN number for the Dealership

4. ESTABLISHED PLACE OF BUSINESS

a. Zoning form executed to include with the Application Packet: Have the county or city zoning office sign the zoning certificate or have the city or county zoning office execute a zoning approval letter on the county or city letterhead stating the zoning is appropriate for a used motor dealer license at that location.

b. Some of the Pictures to include with the application -  

  • Picture of the outside of the Building

  • Up-close picture of sign showing the business name or Marquee stating the Business located within the building

  • Outside of the Office Door displaying the name of the business and the suite number (if applicable)

  • Desk and 2 chairs for customers

  • Picture of landline telephone

  • Picture of file cabinet with the key hanging from the lock

5. FINGERPRINT RECEIPT -THE FINGERPRINTING POLICY
The state must first receive your application packet prior to being fingerprinted. Prior to sending your Used Motor Dealer Application Package to the State, you must register and pay online. Make sure you print your Receipt when registering to provide the state a copy of the receipt in your application package as well as have a copy to carry with you to be fingerprinted.

6. OBTAIN A GA SALES TAX NUMBER

You must have the correct Legal Name, DBA Name (if applicable), and the correct dealership address to include the suite number if applicable to your situation. You must file the sales tax monthly report by the 20th of the month after the date listed as your first sale date during the setup of your sales tax account. Make sure you use the NAICS Code 441120 Used Car Dealers

7. SECURE A $35,000 GEORGIA USED MOTOR VEHICLE DEALER BOND

a. The bond must expire on September 30th of even years.

b. Bond must be in the exact name of the business.

c. Bond must be original and have “power of attorney” attached.

d. Bond must be signed and you should keep a copy for your files.

e. NOTE: A separate Bond is required for each licensed location

8. OBTAIN GARAGE LIABILITY INSURANCE

a. Policy number (binders will not be accepted)

b. Limit Amounts – minimum of 50K/100K/25K or a single limit of $125,000 (GARAGE LIABILITY COVERAGE must be shown; AUTOMOBILE LIABILITY ONLY will not be accepted)

c. “Location” on the certificate must show the exact name and address as shown on the application.

d. “Certificate Holder” must be State Board of Used Motor Vehicle Dealers.

9. DRIVERS LICENSE COPY -INCLUDED IN PACKET:
Upload a copy of your Driver’s License in the Application Packet

10. LANDLINE PHONE:
In the Dealership name -showing the location address – Make sure the phone rings and can be heard ringing at the dealership. The inspector will call the number and will require that it can be heard ringing at the office location

11. AFFIDAVIT’S NOTARIZED
Affidavits in the application are notarized and completed properly (Use the LLC affidavit if you are an LLC/Corporation or the partnership affidavit if you are a Partnership-DO NOT SEND BOTH) - Make sure you include a copy of your Drivers License with the Affidavit of Citizenship

12. MOST IMPORTANT REQUIREMENT
If you answer “YES” to any question on the Background Section because you have been arrested and fingerprinted, you must include a copy of the certified Court Disposition in the application packet. It does not matter if (a) the age of the matter (b) if the charges were dropped (c) please Nolo Contendere (d) the charges have been expunged (e) you filed as the first offender (f) your case was dead docked (g) your matter was Nolle Prosequi (process). YOU MUST STILL INCLUDE A COPY OF ANY COURT DISPOSITION. If the court clerk cannot find the matter because of the age, they must provide a letter on the court letterhead stating that a due diligent search was performed, and the matter was not able to be located due to how old the matter is and the records the court retains.
